General Conditions of Sale (GCS) – AéraGo
1. Preamble
These General Terms and Conditions of Sale (hereinafter "GTC") govern sales made on the website https://aérago.com (hereinafter the "Site"), published by the company AéraGo (hereinafter "the Seller"), registered with the RCS of [city] under number [SIRET].
Any order on the Site implies unreserved acceptance of these General Terms and Conditions.
2. Products
The products offered for sale are those described on the Site. AéraGo takes particular care in the presentation and description of these products in order to best satisfy the consumer's needs. However, errors or omissions may occur, and AéraGo cannot be held liable.
3. Order
The Customer can place an order via the Site, 24 hours a day, 7 days a week. Validation of the order by the Customer constitutes acceptance of the prices, products, and these General Terms and Conditions.
The order is confirmed by AéraGo by email. The Seller reserves the right to refuse any order for legitimate reasons (particularly in the event of an anomaly in the order or a previous dispute with the Customer).
4. Price and Payment
The prices displayed on the Site are indicated in euros, all taxes included (TTC), excluding delivery costs.
AéraGo reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.
Payment is due immediately upon ordering and is made by credit card, PayPal or any other secure method offered on the Site.
5. Delivery
Products are delivered to the delivery address indicated by the Customer when ordering. Delivery times are mentioned on the Site for information purposes only.
AéraGo cannot be held responsible for delays due to carriers or circumstances beyond its control.
6. Right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to provide reasons or pay penalties.
To exercise this right, the Customer must notify their decision by email or via the return form accessible on the Site.
Products must be returned in perfect condition, unused and in their original packaging. Return costs remain the responsibility of the Customer from the fifth return.
No returns will be accepted beyond the legal period of 14 days.
7. Guarantees
The products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
In the event of a defective or non-compliant product, AéraGo undertakes to replace or refund the product concerned, subject to return under the defined conditions.
8. Responsibility
AéraGo cannot be held liable for any indirect damages that may arise from the purchase of products. AéraGo's liability is in any event limited to the amount of the order.
9. Intellectual property
All elements of the Site (texts, images, logos, etc.) are the exclusive property of AéraGo. Any reproduction, in whole or in part, is strictly prohibited without prior authorization.
10. Personal data
AéraGo collects and processes Customers' personal data in compliance with the GDPR. The Customer has the right to access, rectify, and delete their data by writing to: service.client@aerago.com
11. Disputes – Applicable law
These T&Cs are subject to French law.
In the event of a dispute, an amicable solution will be sought. Failing this, the French courts will have sole jurisdiction.
